  1. Introduction

Welcome to HomeConnect Thailand. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

  1. Definitions
  • Client: Any individual or entity using the services of HomeConnect Thailand.
  • Property: Any real estate property listed or managed by HomeConnect Thailand.
  • Services: All services provided by HomeConnect Thailand, including property listing, management, and consultancy.
  1. Services Provided
  • Property Listing: We list properties for sale or rent on behalf of property owners.
  • Property Management: We manage properties, including maintenance, tenant relations, and rent collection.
  • Consultancy: We provide real estate consultancy services to clients.
  1. Client Obligations
  • Accurate Information: Clients must provide accurate and complete information about the property and their requirements.
  • Compliance: Clients must comply with all applicable laws and regulations related to property transactions.
  1. Agency Obligations
  • Confidentiality: We will maintain the confidentiality of all client information.
  • Professional Conduct: We will conduct our services with professionalism and integrity.
  1. Fees and Payment
  • Service Fees: Clients agree to pay the service fees as outlined in the agreement.
  • Payment Terms: Payment terms will be specified in the service agreement.
  1. Cancellation Policy
  • Client-Initiated Cancellation: Clients may cancel the agreement by providing 7 days’ written notice. Any fees paid in advance will be refunded on a pro-rata basis, minus any costs incurred by the agency up to the cancellation date.
  • Agency-Initiated Cancellation: We reserve the right to cancel the agreement if the client breaches any terms and conditions. In such cases, no refund will be provided.
  1. Refund Policy
  • Eligibility: Refunds are only available for services that have not been fully rendered. If a client is dissatisfied with our services, they must notify us within 7 days of the service date.
  • Process: To request a refund, clients must submit a written request detailing the reason for the refund. We will review the request and respond within 7 days.
  • Refund Amount: If approved, the refund amount will be calculated based on the portion of services not rendered, minus any costs incurred by the agency.
  • Non-Refundable Fees: Certain fees, such as administrative or processing fees, are non-refundable.
  1. Dispute Resolution
  • Negotiation: In the event of any dispute arising out of or in connection with these terms and conditions, the parties agree to first attempt to resolve the dispute through friendly negotiation.
  • Mediation: If the dispute cannot be resolved through negotiation within 7 days, the parties agree to submit the dispute to mediation, with a mediator mutually agreed upon by both parties.
  • Arbitration: If mediation fails, the dispute shall be finally resolved by arbitration in accordance with the rules of [Arbitration Institution]. The arbitration shall be conducted in Thailand, and the language of arbitration shall be Thai.
  • Binding Decision: The decision of the arbitrator shall be final and binding on both parties.
  1. Indemnification
  • Client Indemnification: The client agrees to indemnify, defend, and hold harmless HomeConnect Thailand, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with the client’s use of our services, breach of these terms and conditions, or violation of any law or the rights of a third party.
  • Agency Indemnification: HomeConnect Thailand agrees to indemnify, defend, and hold harmless the client from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with the agency’s breach of these terms and conditions or violation of any law.
  1. Confidentiality
  • Confidential Information: Both parties agree to keep confidential all information that is disclosed during the course of the agreement and is marked as confidential or would reasonably be considered confidential.
  • Use of Information: Confidential information shall only be used for the purposes of fulfilling the obligations under this agreement.
  • Exceptions: Confidential information does not include information that is publicly known, already known to the receiving party, independently developed by the receiving party, or required to be disclosed by law.
  1. Limitation of Liability
  • No Guarantees: We do not guarantee the sale or rental of any property.
  • Liability: Our liability is limited to the amount of fees paid by the client for the services.
  1. Termination
  • By Client: Clients may terminate the agreement by providing written notice.
  • By Agency: We may terminate the agreement if the client breaches any terms and conditions.
  1. Governing Law

These terms and conditions are governed by the laws of [Jurisdiction].

  1. Amendments

We reserve the right to amend these terms and conditions at any time. Clients will be notified of any changes.

  1. Arbitration
  • Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these terms and conditions, including the breach, termination, or validity thereof, shall be resolved by arbitration in accordance with the rules of [Arbitration Institution].
  • Location and Language: The arbitration shall be conducted in Thailand, and the language of arbitration shall be Thai.
  • Binding Decision: The decision of the arbitrator shall be final and binding on both parties.
  • Costs: The costs of arbitration, including the fees of the arbitrator, shall be borne equally by both parties unless otherwise determined by the arbitrator.
  1. Force Majeure
  • Definition: Neither party shall be liable for any failure or delay in performing their obligations under this agreement if such failure or delay is caused by circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, strikes, labor disputes, government orders, or natural disasters.
  • Notification: The affected party shall notify the other party as soon as practicable of the occurrence of a force majeure event and shall use reasonable efforts to mitigate the effects of such event.
  • Resumption of Performance: The obligations of the affected party shall be suspended for the duration of the force majeure event, and the time for performance shall be extended by a period equivalent to the duration of such event.
  1. Severability
  • Severability: If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of the agreement, which shall remain in full force and effect.
